I have been put on house arrested until my court date the crime they are charging me with is credit card fraud but when my lawyer talked to me he said they have added Identity theft to the 1st charge so now it credit card fraud and identity theft.
How long of a sentence do you get for these two crimes?
Will i skip jail and go to prison?

Credit card fraud and Identity theft are charges that go hand in hand. The district attorney’s office may add and delete charges at anytime. The second charge was just applicable to the offense committed. I can’t tell you if you will or will not go to jail. The length of a jail sentence is dependant on ones previous criminal record. I would not sweat it. Relax let your lawyer do some work. Good luck and stay out of trouble!
You committed two separate crimes, hence you are charged with both of them.
And the Identity Theft Penalty Enhancement Act signed in 2004 means you could face 2 years in prison. And thats just for the ID Theft charge.
You didn’t say whether these were state (and which state) or federal charges.
Federal charges (at the max) could be as long as 6 years in federal prison. State charges will vary according to their law, to use NJ as a baseline, depending on degree you are looking at 4-6 years in a state prison. The amount of the fraud will be a major factor in determining the amount.
